1. Agreement to Terms & Permanent Establishment

By accessing or using JamaicanReply ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. JamaicanReply is owned and operated by Kortesy Group Limited ("we", "us", "our"), a company incorporated under the laws of Jamaica, with its registered establishment at Lot 235 Phoenix Park Village, Greater Portmore, St. Catherine, Jamaica.

2. Description of Goods & Services

JamaicanReply provides an AI-powered conversational commerce platform for restaurants and retail merchants in Jamaica and the Caribbean. The Service enables businesses to automate customer interactions, take food and beverage orders, manage table reservations, process online card payments, and track order fulfillment in real time.

3. Account Registration & Security

You must create an account to use the Service. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when registering.

4. Acceptable Use

You agree not to use the Service to:

  • Send spam, misleading, or fraudulent messages to customers
  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Transmit harmful, offensive, or unlawful content
  • Attempt to reverse engineer or compromise the Service

5. Payments, Currencies & Processing Security

All online card transactions processed through CaymanReply are secured by First Atlantic Commerce / Powertranz in partnership with National Commercial Bank (JNCB) as the acquiring bank.

  • Accepted Card Schemes: Visa and Mastercard. All transactions are authenticated using 3D Secure 2.0 (Visa Secure and Mastercard Identity Check) to prevent fraudulent activity.
  • Transaction Currencies: Transactions are billed in Cayman Islands Dollars (KYD, ISO 136) or United States Dollars (USD, ISO 840) as explicitly indicated on the order summary prior to checkout.
  • Cardholder data: Card numbers and security codes pass through our payment endpoint to the gateway and are never stored, logged or retained by CaymanReply. Every transmission is encrypted with TLS, and authorisation is performed by PCI-DSS Level 1 certified gateway infrastructure operated by First Atlantic Commerce / Powertranz.
  • Business Subscriptions: Merchant platform subscription billing is invoiced periodically. Subscriptions may be settled via direct electronic transfer or approved card billing.

6. Delivery & Pickup Policy

For food, beverage, and retail orders placed with merchant partners via CaymanReply:

  • Pickup Orders: Customers receive real-time status updates via their order tracking link when items are preparing and ready for collection at the merchant's physical location.
  • Delivery Orders: Delivery is fulfilled within designated geographic zones across Grand Cayman as configured by the merchant. Estimated delivery times and applicable delivery fees are calculated and clearly displayed prior to order confirmation.
  • Special Conditions: Delays resulting from adverse weather, peak traffic, or incorrect contact details will be communicated via customer messaging or phone.

7. Export Restrictions

Physical goods and culinary orders placed through CaymanReply are fulfilled strictly for local consumption and collection within the Cayman Islands. We do not export physical merchandise or food products across international borders.

8. Free Trial & Merchant Invoicing

Merchant accounts include an introductory 7-day free trial. No credit card is required to begin. Following the trial, continued access requires an active invoiced subscription plan.

9. AI-Generated Content

CaymanReply uses artificial intelligence to generate customer responses. You acknowledge that AI-generated responses may occasionally be inaccurate or incomplete. Merchants are responsible for reviewing business information, pricing, and menus used to inform the AI.

10. Data Protection & Privacy

We process personal data in line with our Privacy Policy and applicable data protection law. Cardholder data is handled to the PCI DSS requirements that apply to us, and is authorised by a PCI-DSS Level 1 certified gateway.

11. Limitation of Liability

To the maximum extent permitted by law, CaymanReply and Kortesy Group Limited shall not be liable for any indirect, incidental, or consequential damages. Our total liability under any claim shall not exceed the amount paid to us in the three months preceding the claim.

12. Service Availability

We strive for continuous service uptime but do not guarantee uninterrupted access. Scheduled maintenance and unforeseen network disruptions may occur.

13. Cancellation & Termination

Merchant subscriptions can be cancelled at any time by contacting info@jamaicanreply.com. Customer orders may be cancelled prior to the restaurant commencing preparation, as outlined in our Refund Policy.

14. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Jamaica, where Kortesy Group Limited is incorporated. Any disputes shall be resolved within the competent courts of Jamaica.
